Nintendo Sues Over Premature Switch 2 'Mockup' Reveal

Nintendo has initiated legal action against accessory manufacturer Genki, alleging trademark infringement following Genki's display of a "Nintendo Switch 2" mockup at CES 2025, months before Nintendo officially unveiled its new console. The controversy began when Genki showcased its Switch 2 mockup, claiming it was based on a real Switch 2 system they had access to, which they used to design their accessories.

In court documents reviewed by IGN, Nintendo accuses Genki of launching a "strategic campaign" to exploit public interest in the upcoming console. The lawsuit charges Genki with trademark infringement, unfair competition, and false advertising. Nintendo argues that Genki's early access claims and public handling of the mockups misled consumers about the compatibility of Genki's products with the Nintendo Switch 2.

According to the court papers, Genki began advertising in January 2025 that it had unauthorized access to the unreleased Nintendo Switch 2. Despite later contradictory statements from Genki about possessing a console, the company continued to assert that its accessories would be compatible with the new console upon release.

View 3 ImagesNintendo further claims that Genki infringed on its trademarks through its advertising and directly competed with Nintendo and its authorized licensees. Additionally, Nintendo highlighted a tweet from Genki's CEO, Edward Tsai, and a pop-up on Genki's website suggesting unauthorized access to Nintendo's headquarters.

Nintendo is seeking to prevent Genki from using the "Nintendo Switch" trademark in its marketing, demanding the destruction of any products or marketing materials referencing Nintendo's branding, and requesting damages for the alleged infringements, which it seeks to have tripled.

In response, Genki issued a statement on social media acknowledging the lawsuit and their commitment to addressing it with legal counsel. They emphasized their independence and dedication to creating innovative gaming accessories, while continuing preparations for PAX East and expressing gratitude for the support they've received.

The Nintendo Switch 2 is scheduled to launch on June 5, with pre-orders opening on April 24 at a price of $449.99. High demand has led Nintendo to warn U.S. customers that release date delivery is not guaranteed. For more information, check out IGN's Nintendo Switch 2 pre-order guide.
